MINUTES OF APRIL 12, 2004
A. Call to Order
Schreiber called the meeting to order at 7:34 p.m.

Calvert was seated for Blessing part-way through the meeting.
D. New Business
1. File #W2004-07 – Application for restoration and grading in upland review area on
property at 315 Daleville Road (Map 7, Lot 10). Owner/Applicant: Harold W. Bruce
III. (Received 3/8/04; Decision by 5/10/04.)
John Graves from All-Phase Enterprises said he had finished a grading plan and a brief narrative, which he presented. He said they have plans for pulling back material, leaving a better than 2:1 slope, which will be seeded and mulched. He said the fill will stay within one area. He said that he wanted to get the situation resolved as soon as possible. He said that anything solid, like concrete, will be taken off-site.
Schreiber recused himself from this application since Mr. Bruce is a neighbor.
Mr. Graves said an excavator will be used.
Mr. Bruce said he wanted to get the project started as soon as possible.
Metzler said we have received the topo plan and narrative.
MOTION: To approve proposed grading plan and narrative for slope stabilization
and planting as shown with the following conditions:
1. Maintenance of silt fence and hay bales,
2. Staff will monitor the project,
3. At end of construction, inspection again by staff to check silt fence
and material against it (final approval).

Jones said they should call Staff before starting any work.

2. File #W2004-06 – Application for a 3-lot subdivision on property located at 6l
Mihaliak Road (Map 45, Lot 1). Owner/Applicant: Mary Litwinczyk. (Received
2/23/04; Decision by 4/26/04.)
Ed Pelletier from DATUM Engineering handed out new plans. He said that at the last meeting several questions were raised, including that the Eastern Highlands Health District didn’t have a favorable review. He said several items have changed since then. He said that Ray Crossen is in the process of purchasing Lot #1. He said the septic system design has been submitted to the Health District, and that there is no activity within the regulated area. He said that Lot 1 has been approved, but that the standpipes are still being monitored for Lots 2 and 3 until the middle of May. He said the plans are designed for 18” mottling.
Metzler said that Lot #3 is our only jurisdiction. He said the only proposed activity is the discharge.
MOTION: To approve application for File #W2004-06 contingent upon approval
from Eastern Highlands Health District.

3. File #W2004-09 – Application for a Single Family Dwelling on property located
at 92 Balazs Rd. (Map 49, Lot 5). Owner: John Balazs; Applicant: KMC, LLC.
(Received 4/12/04, Decision by 6/14/04.)
No one was present; tabled until next meeting.
E. Old Business
1. File #W2003-44 – Notice of Violation – Filling of a wetlands and grading and filling
activity within the upland review area without permits on property located at 315
Daleville Road (Map 7, Lot 10B). Owner: Harold W. III & Rene Bruce; Contractor:
All-Phase Enterprises, Inc.
This was discussed under New Business.
2. Violation: TravelCenters of America (the Lessee) and George Giguere of Royce
Properties (the Owner) of property located at 327 Ruby Road.
This violation will be discussed at the next meeting.
F. Correspondence
1. Notice of Violation dated March 30, 2004 from IWC to Joseph Voboril
Violation #W2004-01
Correspondence was discussed.
G. Approval of Minutes
MOTION: To approve March 22, 2004 minutes.

Result: Motion passes unanimously.
Approval of the April 1 minutes was tables until the checklist from Yorgensen is received by the Commission.
H. Staff Report and Discussion
Town aquifers were discussed.
Metzler said the IWC will be given authority to regulate the aquifers within Willington. He said we will have to adopt or modify the state model regulations. He said that preliminary mapping has been done and 7-8 properties have potential contamination within the South Willington basin. He said that underground tanks are considered potential hazards.
